Definition

“Shen Sports” shall mean Shen Sports (Pty) Ltd, registration number 1966/009182/07 and any branches, franchises, associate companies or assigns trading under the same title. Shen Sports (Pty) Ltd is a business in the sports and recreational industry and supplies martial arts equipment and functional fitness equipment.

Technical Data And Dimensions

Data of all descriptions is obtained from manufacturers of the specific products. Whilst every caution is exercised to ensure accuracy, the manufacturers and Shen Sports offer no guarantee of the absolute correctness thereof.

Delivery

The cost of road, rail and airfreight charges are for the purchaser’s account unless otherwise stated. The risk of goods transported passes to the purchaser on delivery of the consignment to the freighter. Insurance will only be effected at the specific request of the purchaser. Subject to availability and receipt of payment, requests will be processed within 2 working days and delivery confirmed by way of email or telephone call. Your order will be shipped as an economy service with a courier company and should reach major delivery centers within 2-3 working days. The calculated courier costs are only applicable to orders within South Africa.

Limitation Of Liability

In the event a product on this website being priced incorrectly or having incorrect information attached due to clerical errors or product information that has been given to us by our suppliers, we reserve the right to refuse or cancel any orders made for said items at the incorrect price. If the order has been cancelled and you have already been charged, a credit will be issued immediately for the payment amount once the matter has been addressed. While we make every effort to ensure the safety and integrity of any content, we do not warrant that this site, it’s servers or e-mails are free of errors, viruses or other harmful content.

The products sold on this website are intended to be used during physical training during which you risk the possibility of serious injury, disability or even death. By engaging in physical training you are agreeing that you do so at your own risk, of your own will, assuming all risk of injury to you yourself. You also agree that Shen Sports is not liable for and takes no responsibility in the event of any injury or harm that occurs to any person/persons using our products. We encourgae you to use our equipment only under the supervision of a skilled instructor/trainer who responsibly monitors techniques, intensity of training and assures that their clients are properly trained and physically conditioned. Minors using these products should have constant, qualified, adult supervision. Do not use old, modified, damaged, or improperly fitted equipment as the condition or effectiveness of the product may diminish with time and use. Consult your physician before beginning any exercise program and know your limitations.

Weapons

All martial arts weapons sold on this website are recommended for display and demonstration purposes only. Any other use of these products are done so at your own risk. We will not take responsibility for improper or illegal use or modification our our weapons. Our customers must be at least 18 years of age and will be required to present proof if needed. We encourgare our customers to check with the authorities if weapons sold on this website are allowed in public and it is the buyer’s responsibility to do so. Shen Sports is not liable for any items seized by the authorities. For our international clients please check with customs in your country as to the legality of the items and if permits are required for customs clearance.

Return And Refunds Policy

The provision of goods and services by Shen Sports (Pty) Ltd is subject to availability. In cases of unavailability, Shen Sports (Pty) Ltd will refund the client in full within 3 days. Cancellation of orders by the client will attract a R50 administration fee if the order was paid for via the Card Payment Option. Customer Privacy Policy

Shen Sports (Pty) Ltd shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). Payment Options

Payment may be made on this website via Visa and MasterCard as well as EFT.

Card Acquiring And Security

Card transactions will be acquired for Shen Sports (Pty) Ltd via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) an no card details are stored on the website. Customer Details Separate From Card Details

Merchant Outlet Country And Transaction Currency

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

Responsibility

Shen Sports (Pty) Ltd takes responsibility for all aspects relating to the transaction including sale of goods sold on this website, customer service and support, dispute resolution and delivery of goods.

Country Of Domicile

This website is governed by the laws of South Africa and Shen Sports (Pty) Ltd chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, 89 Garfield Road Kenilworth 7700.

Variation
